By purchasing any wine from Firewines.com, you agree that you are bound by the following Terms and Conditions:
All wine is sold AS-IS, without any representations or warranties, express or implied, including, but not limited to, as to merchantability, fitness for a particular purpose or the correctness of the catalog or other description of physical condition. Old wines are NOT guaranteed for drinkability. All risks of loss and damage to wine passes to you upon shipment of the wine purchased and we are not responsible for any acts or omissions in connection with the packing or shipping of the wines or of carriers, whether or not recommended or selected by us. All wines purchased are nevertheless insured for shipping purposes. You shall pay any applicable state and local taxes, and any applicable compensating use tax of another state which we may be required by law to collect at the time of the payment of the purchase price. In addition to other remedies available to us by law, we reserve the right to impose from the date of sale a late charge of 1 1/2% per month on any unpaid amounts. These Terms and Conditions of Sale, as well as your and our respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of Oregon. You consent to the exclusive jurisdiction with any wine purchased from us. In no event shall our liability ever exceed the purchase price actually paid by you for such wine. Purchasing and Shipping Wine Legally: You must be 21 years of age to purchase and/or receive wine from us. Returns and Cancellations: There will be a 10% restocking/cancellation fee enforced for any order that is cancelled by the customer, including pre-arrival and Future orders.
All wine sold by us is maintained at optimum conditions. We consider wine to be out of our control once it has been handed over to the shipper, and we cannot be responsible for improper storage after it has been delivered, and as such we cannot accept returns for the following: 1. Wine that does not coincide with personal taste. 2. Wine adversely affected by customer storage. 3. Wine affected by any other adverse condition or conditions while in the care of the customer.
In accordance with State Shipping Laws, Firewines.com is not permitted to ship orders to the following states: Alabama, Arkansas, Delaware, Kentucky, Massachusetts, Mississippi, Montana, New Jersey, Oklahoma, Pennsylvania, South Dakota, Texas and Utah. Although Firewines.com cannot ship to the above listed states, we can for ship to a neighboring state for your convenience.
Purchasing
Buyers in the USA must certify that they are at least 21 years of age, and buyers in the European Union must certify that they are at least 18 years of age. Buyers will have to certify this information on our secure order server before placing an order. Further certification may be required at time of delivery. The billing address needs to be the same address on your credit card statement. Your billing address is where your order will be shipped. If you wish to ship to an address different than your billing address, please provide this information on your order form.

Pricing Errors and Omissions Excepted
Occasionally, our listed prices may be incorrect or the bottle size may be incorrect. For example a 750ml size may be incorrectly priced as a 375ml bottle. When such situations occur, Firewines.com shall be held harmless for the error. We make every effort to make sure that our product database is accurate, however mistakes do happen. We will not be responsible for typographical errors. In all cases, the customer will be contacted before any charges are made to the credit card for a decision to proceed or not proceed with the order at the correct price.
Returns
Because of the fees charged by your credit card company when we charge and subsequently credit your card, we will enforce the collection of our restocking fee, if your card has already been charged. We charge your card when your order is pulled from inventory, packed, and prepared for shipping. If we have not charged your credit card, you may cancel the order without being subject to our restocking fee. If we have already charged your card, the cancelled processed credit card order for wines in-stock, shipped or not, are subject to a 10% restocking fee. Cancelled processed credit card special orders are also subject to a 10% restocking fee. Please check your order receipt carefully to make sure you ordered the correct wine. We will not be responsible for any incorrect orders placed by you, the customer. Any incorrect orders that are processed and shipped will be subject to a 10% restocking fee, as well as shipping charges back to us if you want to return the item(s).
Sales Tax
All wine is sold in the State of Oregon, and the title passes to the buyer in Oregon. All purchases shipped to Oregon addresses will not be subject to a sales tax as Oregon does not currently have a sales tax.
